Right of withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period is 14 days from the day on which you, or a third party designated by you other than the carrier, take possession of the goods. For several goods ordered together and delivered separately, the period begins when the last item is received; for goods delivered in several lots or pieces, it begins when the last lot or piece is received.

of your decision to withdraw from this contract by an unequivocal statement, for example a letter sent by post or an email. You may use the model withdrawal form below, but this is not mandatory.

You can also exercise your right of withdrawal online using Withdraw from contract. This function is accessible in the footer of our online shop. If you use this online function, we will promptly send you an acknowledgement on a durable medium, for example by email, containing your withdrawal statement and the date and time of its receipt.

To meet the withdrawal deadline, it is sufficient to send your statement exercising the right of withdrawal before the withdrawal period expires.

Effects of withdrawal

If you withdraw from this contract, we will reimburse all payments received from you, including the cost of the least expensive standard delivery we offer. Additional costs arising from your choice of another delivery method are not reimbursed. Reimbursement will be made without undue delay and no later than 14 days after we receive your withdrawal statement. We will use the same means of payment as for the original transaction unless expressly agreed otherwise with you; you will not incur reimbursement fees.

We may withhold reimbursement until we have received the goods back or you have provided evidence that you have sent them back, whichever occurs first. This does not apply if we have offered to collect the goods.

You must send back or hand over the goods without undue delay to XPLORCYCLES GmbH & Co. KG, Richthofenstraße 96, 32756 Detmold, Germany. We voluntarily extend the statutory return period of 14 days in your favour to 30 days from the day on which you notify us of your withdrawal. The deadline is met if you send the goods before those 30 days expire. This extension applies only to returning the goods; the period for declaring withdrawal remains 14 days. If we have offered to collect the goods, you do not have to send them back yourself.

You bear the direct cost of returning the goods. For the return of one complete trike from mainland Germany to Detmold, this cost is estimated at a maximum of approximately EUR 1,200 including VAT. The stated freight price for complete bikes applies only to mainland Germany. Delivery to islands, including islands accessible by road, is excluded. International delivery is subject to individual agreement: before accepting your order, we clarify delivery availability, transport costs and the return costs applicable to the specific destination with you. For other goods which, by their nature, cannot normally be returned by post, the estimate remains a maximum of approximately EUR 200. These amounts are cost estimates, not flat-rate return charges.

You are only liable for any diminished value resulting from handling the goods beyond what is necessary to establish their nature, characteristics and functioning.

Exception for individually made goods

The right of withdrawal does not apply to contracts for goods that are not prefabricated and whose production is determined by an individual choice or decision by the consumer, or that are clearly personalised (section 312g(2), no. 1 of the German Civil Code). This exception applies only where the statutory requirements are met in the individual case.
